Please review the Agreement before you purchase any Fonts from calamar.studio.

By downloading, installing and/or embedding font software (“Fonts”) made available on calamar.studio and designed by PE Oksana Petrenko (“Calamar Studio”), you (“Licensee”, "You") agree to be bound by the following terms and conditions of this End User Licensing Agreement (“EULA”):

This License Agreement is an agreement between:

The “Licensee” or "You" who is the individual person indicated as the licensee during the purchase process or that person’s employer if that person is acting on the employer’s behalf and with the employer’s authorization and the seller (“Calamar Studio”) as licensor. If you are purchasing on behalf of your employer, then only your employer is the “Licensee” and can use the Font or Fonts subject to the terms of this License Agreement; in that case you represent and warrant that you have full legal authority to bind your employer, as the Licensee, to the terms of this License Agreement.

All digital content available on calamar.studio, including, without limitation, the Fonts, is protected by international copyright laws and treaties. As between you and seller, Calamar Studio retains ownership of the Fonts, but grants to you certain rights to use the Fonts on the following terms. All other rights are expressly reserved by the Calamar Studio.

Upon receipt by Calamar Satudio of all applicable fees, you are granted a non-exclusive, non- transferable right to use, the Font worldwide, in perpetuity, as expressly permitted by the license herein and subject to the terms set forth herein.

PERMITTED USES

1. Install the Font on a single Web Server and single domain provided that both the web server and domain are either owned or controlled by You.
2. Use the Font using the @font-face CSS selector only provided that an appropriate reference to the copyright and legal information is entered as comments in the production code of the website.
3. The total traffic, measured in page views, of all Websites using a Licensed Web Font must be no greater than the number of page views specified at checkout. 
4. You cannot link the Font Software across multiple domains.
5. Export the font Yourself to a secure Woff and Woff2 that must be protected, i.e. for Web Only. 
   

PROHIBITED USES

1. Use the Font in such a way that a user or visitor of Your web site can download the Font. It must be stored securely and appropriately protected. 
2. You cannot link the Font across multiple domains.
3. The Font may not be used in any web-based applications where the Font are used within an application that is sold or made available for free, or in any other way is distributed for use outside of use within a web browser, an ePub or PDF document of any kind. 
4. The Font may not be used in any web-based applications where users can select and/or use any Font for printing purposes, or in any merchandising scenario (i.e. editable invitations, apparel design, et al). Usage in softwares like Templett, Corjl, Canva, etc is not allowed with Weblicense.
5. Use of the Licensed Web Fonts with technologies other than @font-face, such as sIFR, Cufón or Typeface.js, is not allowed.
6. Resell the Font as is, or any derivative of the Font.
7. Distribute the Font Software with client proofs, templates, or in un-flattened files except as provided for in the license grant.
8. Share, lend, rent or distribute the Font Software with any third parties except as expressly granted above.
9. You may not rent, lease, sublicense, give, lend, or further distribute the Font, or any copy thereof, except as expressly provided herein. 
10. Allow your customers to individually personalize or customize their own physical goods for resale.
11. Offer the Font Software in a giveaway or promotion.
12. You may not alter Font Software for the purpose of adding any functionality that such Font Software did not have when delivered to you by Calamar Studio.

STRICTLY PROHIBITED USES

1. Use the Font in pornographic, fraudulent, immoral, infringing, illegal, harassing, offensive, or defamatory material, is strictly prohibited, including, without limitation, any use of the Font that:

(i) may create a risk of harm, loss, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to you, to any other person, or to any animal;

(ii) may create a risk of any other loss or damage to any person or property;

(iii) seeks to harm or exploit children by exposing them to inappropriate content, asking for personally identifiable details or otherwise;

(iv) may constitute or contribute to a crime or tort;

(v) contains any information or content that we deem to be unlawful, harmful, abusive, racially or ethnically offensive, defamatory, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to other people (publicly or otherwise), libelous, threatening, profane, or otherwise objectionable;

(vi) contains any information or content that is illegal (including, without limitation, the disclosure of insider information under securities law or of another party's trade secrets);

(vii) contains any information or content that you do not have a right to make available under any law or under contractual or fiduciary relationships;

(viii) contains any information or content that you know is not correct and current; or

(ix) promotes racism, bigotry, hatred or physical harm of any kind against any group or individual.

2. Falsely representing authorship and/or ownership of the Licensed Asset is strictly prohibited.

3. Any other use that is not expressly permitted in PROHIBITED USES section is strictly prohibited.

COPYRIGHT

The Font is protected by copyright law. Calamar Studio is the sole, exclusive owner of all intellectual property rights, including rights under copyright and trademark law.  Licensee agrees not to use the Font in any manner that infringes the intellectual property rights of Calamar Studio or violates the terms of this EULA.

DISCLAIMER OF WARRANTIES

Licensee’s use of the font is at licensee’s own risk. The font is provided on an "As is" and "As available" basis, without any warranties of any kind, either express or implied. Calamar Studio hereby disclaim all warranties of any kind, whether express or implied, statutory or otherwise, including but not limited to any warranties of merchantability, non-infringement and fitness for particular purpose. The foregoing does not affect any warranties which cannot be excluded or limited under applicable law.

LIMITATION ON LIABILITY

In no event will Calamar Studio be liable for damages of any kind, under any legal theory, arising out of or in connection with this license agreement, including, without limitation, your use, or inability to use, the licensed asset, including any indirect, special, incidental, consequential or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), intellectual property infringement, breach of contract or otherwise, even if foreseeable. In no event will the liability of Calamar Studio be liable for damages of any kind, under any legal theory, arising out of or in connection with this license agreement, including, without limitation, your use, or inability to use, the licensed asset, exceed the fees that licensee paid for the licensed asset. The foregoing does not affect any liability which cannot be excluded or limited under applicable law.

INDEMNIFICATION

Licensee agrees to defend, indemnify and hold harmless the Calamar Studio from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including but not limited to reasonable attorneys’ fees) arising out of or relating to Licensee’s (or anyone acting on Licensee’s behalf, including, without limitation, service providers) (i) violation of this License Agreement, (ii) use of the Font in violation of law, rules or regulations, or (iii) use of the Font violation of third party rights where such violation is due to the modification of the Font.

ENTIRE AGREEMENT

This License Agreement constitutes the sole and entire agreement between Licensee on the one hand and Calamar Studio on the other hand with respect to the Font and supersedes all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Font.

MODIFICATIONS

Calamar Studio may modify this License Agreement by posting an updated version on calamarstudio.com. The then current version of the License Agreement posted at the time of purchase shall apply to purchases (even if the Font is downloaded after the License Agreement is updated).
